Special terms and conditions

related to the arranging of transports and releasing of cargos

that are subject to the control executed by

the Russian agricultural controlling service ( Rosselkhoznadzor ) of the

Ministry of Agriculture of the Russian Federation.

 

According to the sub-clause 2 of the item 9.4.11 of the Rules and Regulations for transportation of cargo by Evergreen Group carriers, for acceptance of shipments that are subject to the control executed by Rosselkhoznadzor of the Ministry of Agriculture of the Russian Federation the shipper is obligated to present to the booking office/agents at the loading port the corresponding veterinarian certificate issued by the exporting country ( in original ).

Above mentioned rules are imposed basing on the following regulating documents:

“Supplement to “The Memorandum between the European Union and the Russian Federation dated 02.09.2004 on veterinarian certificates for the animals and animal products exported from the European Union in respect of transportation of animal products from the European Union or transit of such products via the territory of the European Union to the Russian Federation”.

Item 4:

“Cargo transported via the territory of the European Union in transit to the Russian Federation shall be accompanied by the original veterinarian certificate of the exporting country, as well as by the copy of GVDE ( General veterinarian document of entrance ) that shall be issued by the State veterinarian service of the corresponding EU country at entrance and exit of cargo from the territory of EU and that shall confirm the execution of the veterinarian control during the transit”.

Additionally, in order to arrange further transportation of cargo from the transshipment port in Europe to the port of discharge ( St. Petersburg ) the number of the veterinarian certificate for the transported products must be inserted into the corresponding Bill of Lading and Manifest that are issued at the loading port.

Should the number of the veterinarian certificate be missing in the Bill of Lading and/or in the Manifest – the cargo will not be shipped to the port of discharge until:

(a)

(a) the necessary corrections will be done to the corresponding Bill of Lading and/or Manifest in respect of inserting of the veterinarian certificate number;

or

(b)

(a) the original certificate or its copy stamped by the corresponding department of the Federal Service for the veterinarian and phytosanitarian control of the Ministry of Agriculture of the Russian Federation will be presented by the consignee to the corresponding office of LLC «Evergreen Shipping Agency (Russia) Limited» .

All additional costs for the extra storage of container at transshipment port resulting from the lack of the certificate number in the Bill of Lading and/or in the Manifest are to be covered by consignee prior to the shipment of cargo to the port of final destination. If consignee considers the shipper liable for the additional costs occurred at the transshipment port due to the shipper’s fault to present original certificate – settlement of such financial claims should be done directly between shipper and consignee without carrier’s involvement.

Above mentioned rules are imposed basing on the following regulating documents:

“Directives of the Federal Service for the veterinarian and phytosanitarian control of the Ministry of Agriculture of the Russian Federation No. FC-EH-2/7477 dated 31.08.2006”.

In certain cases as an exception the carrier may ship the cargo that is subject to the control executed by Rosselkhoznadzor and that does not have any reference to the number of the certificate in the Bill of Lading and\or in the Manifest from the transshipment port in Europe without presentation by the time of shipment of the copy of the veterinary certificate legalized by the corresponding Russian authorities. In such case the customer shall present to the carrier a corresponding Guarantee Letter issued according to the stipulated form ( please, refer to the corresponding section at our web-site ).

Shipment of cargo without presentation of the copy of the veterinary certificate against the corresponding Guarantee Letter is possible only if the customer has surrendered to the Carrier’s Agent the full set of the dully endorsed original Bills of Lading or in cases of telex-release availability.

Decision regarding shipment of cargo without presentation of the copy of the veterinary certificate against the corresponding Guarantee Letter is subject to the exclusive authority of the Carrier’s Agent.
